Why was my Code Compliance complaint referred to mediation?
The Bellevue Neighborhood Mediation Program is designed to enable citizens to resolve neighborhood problems without government intervention, and at the earliest possible stage.
Frequently, complaints received by Code Compliance are not covered by city code, and yet the problem creates annoyance and friction in the neighborhood. The Bellevue Neighborhood Mediation Program provides residents with a forum for resolving such complaints.
What type of cases are referred to mediation? Referrals fall into two categories:
- No Codes. These cases are automatically referred to the mediation program and include issues such as landscaping, tree and shrub debris, property lines, easements, and noise issues not related to construction or mechanical equipment.
- Cases which have been investigated and no violation has been found. An example of this type of problem may be a complaint about debris and stored material. If the enforcement officer finds that the items are legitimate items and properly stored, then no violation will be issued.
Is mediation still available after calling Code Compliance?
The code enforcement officer will discuss the possibility of using the mediation program prior to enforcement. This alternative is entirely voluntary for everyone involved.
What are the benefits in mediating Code Compliance issues?
Enforcement action can cause hard feelings between neighbors. Mediation allows neighbors to find solutions that work for everyone involved. Those who are most concerned about the issue can work toward solutions that protect what is most important to them. Often people leave the mediation with a new or improved relationship with their neighbor. If a complaint involves code issues, it may be returnedt for enforcement if mediation does not result in a solution that works for all.
What if the agreement is not consistent with the city code?
The Code Compliance Section is complaint-driven. Enforcement officers will investigate if a complaint has been filed. If neighbors can find a solution to the problem between themselves and the complaint is withdrawn, there will be no enforcement action.
In order to avoid potential future complaints that might undermine the mediated agreement, it is important that all interested or affected parties be involved in resolving the problem.
What happens to my complaint if mediation is not chosen?
Mediation is a voluntary process. At any point, the mediation program can return a complaint to Code Compliance.
